In Marbella, on the twenty-eighth of June two thousand and twenty-three.

The matter having been reported, and the [скрыто] [скрыто] attached to the Courts having delivered the translation into RUSSIAN of the letter of request containing the steps sought in the proceedings, let it be added to the relevant case file. Having examined its content, it is ordered that it be sent to the [скрыто] [скрыто] [скрыто] of the MINISTRY OF JUSTICE, via LexNET, so that the appropriate dispatches may be issued by that public body in order to send the LETTER OF REQUEST to Russia on the terms agreed.

Request for Mutual Legal Assistance in Criminal Matters

Punishable acts

On 27 December 2020 the defendant [скрыто] ARTSINOVITCH allegedly published on his Messenger (or another social network) the defamatory and insulting text in the Russian language, which contains the following defamatory statements and insults that attack the honour and dignity of the complainant [скрыто] [скрыто] [sic], and which read verbatim as follows:

"This criminal businessman has created an organised criminal group consisting of his nephew [скрыто] [скрыто], his accountant [скрыто] [скрыто], his driver and a couple of other associates."

"He turned to the thief-in-law [скрыто] [скрыто] of Lotu [скрыто]; and, in 2019 in Dubai, in my boutique at the five-star Al Qaser hotel, some 'hitmen' came to collect the money from me."

"…[скрыто] laundered, through us, his criminal money obtained from smuggling consumer goods from China, for which he was arrested and imprisoned. I explained to the hitmen and their boss that he had deceived them and that I owe nothing to anyone."

"[скрыто] [скрыто] still has criminal romance up his backside. He sits in Marbella like a

spider and pulls the strings from there, running his network of smugglers in Russia and a bunch of lawyers who rob decent citizens through the courts. Blackmail, extortion and assault — this is common practice for [скрыто]. He regularly meets in Spain with criminal leaders of the criminal world of Russia and neighbouring countries. He has repeatedly boasted of meeting [скрыто] [скрыто] and other authorities. He has a group of Lithuanian killers there, whom he hires to do his dirty work."

"[скрыто] has long considered himself a judge of other people's destinies, 'a Godfather'. Although in fact he is an FSB informer who gives the Lubyanka guards information on businessmen for their control. And he positions himself as a divider between the office, the police and the thieves. In fact, he is a common criminal who has made more than 100 million dollars from smuggling. In 2003 he came to me and begged me to introduce him to the legendary bandit [скрыто] [скрыто] [скрыто]."

"He obtained residency in Gibraltar and pays taxes there with his criminal money, not in his homeland in Russia. He laundered tens of millions of dollars through the banks of Zurich, Dubai, Hong Kong and Singapore."

"But [скрыто] has no shame, no conscience and no honour. He is a werewolf!"

"Sitting in Spain, he has a huge flow of shoe smuggling through Kazakhstan via his managers working in Moscow."

"Three weeks ago he again set up a meeting for me with bandits in Dubai. I, my wife [скрыто] and my brother [скрыто] are in real danger. Any of us could be wounded, stabbed in the side, shot in the back, hit by a car, have acid thrown in the face or a bomb placed under the car. [скрыто]'s thugs can plant drugs in our luggage or car, or simply have us arrested by the state, for example. These are all the methods of [скрыто] and his team…"

"If anything happens to us, I [скрыто] [скрыто] TO [скрыто] [скрыто] [скрыто] SERGEEVICH [скрыто] [скрыто] [скрыто] [скрыто]."

Legal classification

Offence of defamation (calumnia) defined in Articles 205, 206 and 211 of the Spanish Criminal Code

Article 205.
Defamation is the accusation of an offence made with knowledge of its falsity or with reckless disregard for the truth.

Article 206.
Defamation shall be punished with imprisonment of six months to two years or a fine of twelve to 24 months if it is spread publicly, and, otherwise, with a fine of six to 12 months.

Article 211.
Defamation and insult shall be deemed to be made publicly when they are spread by means of the printed press, broadcasting or any other means of similar effectiveness.

Offence of insult (injurias) provided for in Article 208 of the Spanish Criminal Code

Article 208.
An insult is an act or expression that harms the dignity of another person, damaging their reputation or attacking their self-esteem.

Only those insults which, by their nature, effects and circumstances, are regarded in public opinion as serious shall constitute an offence, without prejudice to the provisions of Article 173(4).

Insults consisting of the attribution of facts shall not be considered serious unless they were made with knowledge of their falsity or with reckless disregard for the truth.

Grounds for the request

It is necessary to take a statement from [скрыто] ARTSINOVITCH because he has his domicile in RUSSIA, [скрыто] MOSCOW. Telephone [скрыто], [скрыто], and there is evidence that he may be connected with the offence under investigation.

Action(s) requested

That, after being read his rights and in the presence of a Judicial Authority, a statement be taken as a person under investigation from [скрыто] ARTSINOVITCH, of legal age, domiciled at [скрыто] MOSCOW. Telephone [скрыто], [скрыто], and that he be put the list of questions submitted by the complainant, which are:

2.- Did you, on 27/12/2020, publish via the internet, Facebook Messenger and other social networks the following:
